Sabinus is not going down without a fight and has given two popular food brands a 14-day deadline to reimburse him for using his intellectual property or face legal action.
Chukwuemeka Emmanuel, also known as Oga Sabinus, a prominent Nigerian comedian, sketch maker, and content producer, has threatened to sue a popular brand, peak milk, for allegedly using his trademarked phrase, "Something hooge."
Sabinus, 27, also threatened legal action against UAC Food Ltd, which manufactures gala sausage, for utilizing his trademark image and other intellectual property to create advertisements and promotions for the product.
In a pre-suit notice dated May 27, 2022, and signed by his main counsel, Mr Stanley Alieke, the comedian claimed N500 million from Peak Milk for claimed unauthorized use of his intellectual property, and an additional N500m for damages for "emotional, physical, psychological, and mental pain our client has suffered as a result of trademark theft and violation of his intellectual rights property."
According to the comedian, a Peak Milk subsidiary, Friesland Food Wamco Nigerian PLC, exploited his trademarked tagline "Something Hooge" in advertising and promoting their product, Peak Milk.
He disclosed that the advertisement was posted on Peak Milk Nigeria's verified Instagram profile (peak milk) on May 24, 2022. The comedian revealed that the aforementioned term was trademarked on November 26, 2021, with the FILE NINIBER: NG/TM/O/2021/48316.
Sabinus also claimed N100m in a pre-litigation notice to UAC Food Ltd dated 25 May 2022 "for the use of the picture, which is the normal cost our client charges for his picture to be used for ads and promotions."
Oga Sabinus further said that UAC Food posted his "photo" on their verified Instagram account (galasausage roll) on May 23, 2022. He said that the tweet, which featured his cartoon image, was labeled "the way I calculate everything in my life."
"The post gained significant traffic, engagements, and attracted huge followership to your page, which only happened because the picture of our client was used for the promotion and advertisement," the note stated.
The comedian, who was just named Africa Movies Viewers' Choice Award (AMVCA) Best Online Content Creator of the Year 2022, given both corporations 14 working days to meet his requests or face him in court.
